I pray one day soon that the news is flooded with real arrests, that the FBI does raid and seize files, that all gender clinics are closed, that the media finally tells the truth and the lies are exposed. Accountability!

Unfortunately these doctors who perform this care have convinced themselves that they are “helping” patients and are noble for what they do. They ignore the very real harm they are causing and cling to WPATH recommendations and the few positive (but poorly done) studies. They surround themselves with other doctors who have the same opinions and shame anyone who opposes them. I know this from groups of physicians on social media. And when their research is inconsistent with their beliefs, as the article states, they suppress it, again lying to themselves that it will be used to harm trans patients. They are what Peck called “People of the Lie” in a book he wrote. I left the AAP years ago when they became more and more political. And if they do falsify or destroy records that would likely be a prosecutable offense. As to malpractice coverage in Oregon (which I was unaware of.) I would imagine after enough lawsuits the insurers will pull out of the market. They won’t be willing to keep paying the claims.

In Oregon a law explicitly prohibits a malpractice insurer from dropping from coverage a physician because of malpractice claims against that physician if the claims relate to so-called gender affirming care. The insurer cannot even raise premiums for that doctor.

After World War 2 the Allies handed a Questionnaire (Fragebogen) to millions of German and Austrian citizens, to investigate who did what during the war in order to De-Nazify Europe. I’ll open a bottle of Champagne when something like this gets sent out:

Dear Doctor ___,

Our records indicate that you practiced medicine in the state(s) of ___ during the period in question of 2015-2025.

In accordance with The Federal Detransification Act of 2026, we require your answers to the following questions:

1) How many minors did you diagnose with Gender Dysphoria? How many adults?

2) How many minors did you prescribe puberty blockers?

3) How many minors did you prescribe cross-sex hormones? How many adults?

4) On how many minors did you perform a Gender-Affirming surgical procedure? On how many adults?

This is definitely a fantasy I can get behind. But, these physicians will not be arrested. They will be named in medical malpractice lawsuits, which their insurance companies will pay if lost. Maybe that is another front on which this phenomenon could be taken down: medical malpractice carriers no longer agreeing to provide coverage for gender affirming care.

I prefer not to fantasize. I want very much for the trans butchers to be hunted down and punished. I will work towards that goal. I think the best chance is through the federal administration making rules against insurance paying for puberty blockers, cross gender hormones, and mutilating surgery.

As for the part about destroying patient records, that is already happening. Records are being falsified by changing names, changing birthdays, and not keeping long term archives.

I am with you Alexander about our best chance being "the federal administration making rules against insurance paying for puberty blockers, cross gender hormones, and mutilating surgery" at any age. I think the public could get behind that. Even if some thought these "procedures" were OK - they are cosmetic and harmful (not "life saving") and why should others pay for them?

As for destroying patient records - I hear you. But, there are some for whom that will not be possible because the digital footprint is so vast, like Sidhbh Gallagher

Lawsuits are good. Criminal charges are better. Something like post-war De-Nazification is best of all.

After World War 2, Nazi personnel records were a hot potato, too. Thing is, if you piss off enough people, some of them will get back at you.

“When the nearly complete list of Nazi Party memberships was turned over to the Allies (by a German anti-Nazi who had rescued it from destruction in April 1945 as American troops advanced on Munich), it became possible to verify claims about participation or non-participation in the Party.”

Offer a $100,000 reward for whistleblowers who preserve documents that lead to a conviction.

In Oregon, there is a statute that requires all medical malpractice insurers to provide coverage for doctors providing gender affirming care, and forbids malpractice insurers from in any way penalizing doctors who provide that care even when lawsuits are brought against those doctors for that care, such as by cancelling coverage or raising premiums. So the only thing a malpractice insurer will be able to do is to stop offering any coverage to any doctors in Oregon. That may very well happen with some malpractice insurers.

I will bet California has a similar law! Probably also Washington state.

Gender clinics and transgender activists have created "model laws" and pushed to have them passed in blue states.

Then detransitioners would need to sue the Oregon State representatives who passed that law, each and every one!

Expand full comment
Holly Hart's avatar

It is not legally permissible to sue legislators for voting for enactment of a statute. An party with standing to sue can only sue to have a law declared unconstitutional or void because the lawful process for passing a statute and signing it into law by the governor did not take place, such as no legislative quorum was present when the bill was voted on.

The juggernaut that is the transgender movement is very well financed by billionaire men who claim to be women and their woke allies. They prepared decades ago on their battle plan and pay the best national and international law firms (like Denton's) to chart out that battle plan and bring lawsuits and defend against law suits so as to advance their battle plans. It is going to take a lot of time and effort on those who believe in the binary nature of sex and the defense of women's sex-based rights to make up for the lead they have on us.

Executive Order 14187 impacts insurance companies by prohibiting health insurance plans for federal employees from covering gender-affirming care. This order also directs federal agencies to ensure that recipients of federal funding, including those participating in federally supported programs like Medicare and Medicaid, do not provide gender-affirming care.

These restrictions have led to significant legal challenges, with courts issuing injunctions to block parts of the order. Critics argue that the order violates equal protection and due process rights, and some federal courts have temporarily blocked its implementation.

The question remains as to exactly how the federal government can get states like Oregon to stop including so-called gender affirming care in their Medicaid programs. I am not familiar enough with the various relevant federal laws that might enable the Trump administration to cut funding to Oregon's or other states' Medicaid, or what other sticks (or carrots) the feds could use to pressure the Oregon legislature to change state law and stop medical insurers from covering so-called gender affirming care, but the executive order in itself does not do that. It just orders relevant federal agencies to propose and adopt rules and regulations that could accomplish that, and federal agencies right now have fewer staff and will have difficulty investigating all the states that need to be investigated and ordered to change their ways. Oregon is in the 9th Circuit, which is the most woke circuit, so attempts to implement the executive order will likely have to make it all the way up to SCOTUS before Oregon is forced to comply with the executive order.

The battle is happening in the courts. I think the key here is that the federal administration can remove the insurance company from participating in gender affirming care, without regard to which state it is in. Maybe the courts will allow that, or not. That is why we have courts, to decide what is and what is not right. If the federal administration loses in court, we will try something else. I think the biggest weakness of the trans movement is how extreme it is. That very extremism will one day cause it to fail. Meanwhile, President Trump and Pam Bondi (Dept of Justice) are people I trust. They will do their best.

As a retired attorney, I do not understand how the Trump administration could prohibit insurance companies from covering so-called gender affirming care. I have no expertise in insurance law, but I think it is really the states that regulate insurers, and that the federal govt has much less of a constitutional role in doing that. I have not read all of the executive orders that Trump has issued that might be relevant to insurance, and I have no idea what the powers of the federal executive branch really are under the US Constitution or federal laws to regulate relevant insurance.

The extremism of those promoting transgender ideology is definitely a gift! When the UPenn swimmer Will Thomas became conspicuous by dominating women's collegiate swimming, I regarded him as a gift because Americans love athletics and value fairness, and him being allowed to participate in women's competitions was clearly not fair! People did not know or care much about what was happening internationally with men crashing women's cycling or boxing or weight-lifting, or having for years received Olympic medals in women's track and field. But 6'4" Will Thomas got the attention of hundreds of thousands of Americans who follow women's swimming because their daughters are swimmers! And now the same awareness is growing as boys win girls' state competitions in track and field, and girls are now refusing to participate when boys are permitted by school officials to compete as if they were girls.

Apology for me going on and on, but I have been working to protect the sex-based rights of girls and women against the men's rights movement that has tried to conceal itself in the Trojan horse of transgender rights since 2019. I've protested at gender clinics, testified at the Oregon legislature, demonstrated against men being placed in women's prisons, etc., and how, finally, the tide seems to be turning, and the Trump administration is helping to turn that tide!

I certainly hope that the Trump administration can find ways to stop doctors from harming children as they have been doing. I hope they are using every possible route to doing that, in the courts and by carrots and sticks with state and local governments, universities, etc.
